Pain Management Laws Tennessee

Hello Everyone,

Since the State of Tennessee has declared war on Compliant Pain Patients, there is a group starting up to sue the State of Tennessee. These new laws make our Physician and Pharmacist as "Agents of the State". We have been advised by a highly rated trial attorney that these new laws are absolutely UNCONSTITUTIONAL!!!!!!

If anyone is interested in being in a CLASS ACTION LAWSUIT, then contact me {edited for privacy} and we will forward you the literature. We should not be treated like CRIMINALS ! Stand up people... Stand UP.

I'm a pain patient of 22 years,49 years old and have had my medicine lowered 7 times in the last 15 months to the point its not helping,I'm in constant misery and all I get from my doc is we have to meet the morphine equivalents or send you to have either shots,tens implants or a pain pump.Please send me the contact info.its time something was done about this

Tori, Bradley and all in TN. Not just TN with a problem. We are fighting medication issues here in Colorado also. The whole nation is in for a huge problems if something isn't done. How are people allowed to contact each other directly?
I feel if people were paying for $100 of electricity and only receiving $80 worth, they would all be very upset. I feel it's the same thing when I am paying for a medication and receiving an inferior product.

Pain patients are being treated as if we are all junkies. There doesn't seem to be many people who have a real understanding of what we suffer daily. On another thread a lady provided us with a website that explains the difference between chronic pain patients and drug addicted persons. I'll see if I can locate that website and will post it for everyone. A nice lady in AZ wrote a petition for State and Federal governments to try to get someone on our side, before legislation is passed that leaves all of us without treatment. The addressee on the petition is the state of AZ but the website agreed to add all the State Governments of people who sign the petition. That way all are notified and we have a collective group of signatures. The more the better. Please visit the petition and sign. We need all the help we can get.

I am very interested in being a part of any type of lawsuit of this type. I agree this is highly unconstitutional and is a violation of not only my rights but that of practitioners who have went through years of education in order to treat their patients.

Bradley; The date on your post about a possible class-action lawsuit is more than a year ago. I would be more than happy to join as I'm getting the run around with referrals to a pain clinic that TN and my insurance will accept. The pain clinic I've used for the past 8 years and that qualified under laws in effect until just now cannot prescribe the dosage of narcotics I need. He ran a detailed DNA test and determined that I am a "rapid metabolizer", so that, say, a dose that should last 6 hours may last for 3, at most. But I need to know the status of your filing a lawsuit before I do anything else, e.g., is there a lawsuit to join? Can you let me know that, please. And good lucks to all of us--My dosage too have been cut and am in constant pain.

I am willing to join any lawsuit. I am in bad shape here. Pain is unbearable. Will just end up in hospital. I suggest everyone keep using your insurance and go to er. You hopefully get admitted for pain management from your Pcp. If the insurance and hospitals start feeling it in there pocket books they will get on our sides also. If anyone knows a good pain clinic in Memphis to area speak up. I'll go pretty much anywhere. Just needing help here.

Count me in. I think the government has their nose to far up our ass anyway. How do they know better than our Doctors about what meds we need or don't need. We shouldn't suffer for the bad people that are selling their meds. The law hasn't changed a thing anyway as far as pushers go. I still see deals going down every time I go to town. {edited for privacy}.

I agree with all of the complaints. I will sign....I went to new rheumatologist...he treated me awful. I cried and said this is it let me leave as he blocked the door. I said I will not finish this appointment. I advised him I had appointment with pain management in two days. After I said I don't like the way you treated me this doctor in Jackson Tennessee said well then I think you are doctor shopping and now I am red flagged to be watched. It is embarrassing and unnecessary as the pharmacy I go to said you are not doing anything wrong and printed copies to take to my new doctor. Pharmacy said your new doctor can contact us. However.. I'm still red flagged

I think it is unconstitutional. To take the care and well being out of the hands of our family doctor and place us like cattle in pain management centers and treat us like addicts is wrong. Our family doctor knows more about us and takes more time to understand our needs. Our state officials took this on because of people selling pain meds. Well they're still selling. We are not the problem.

Send me the information. I agree that these laws are unconstitutional. I think that Doctors are more qualified to treat than nurse practitioners. Let me know what I need to do.

Please send me the info on the class action lawsuit in tennessee been in pain management for 5yrs or so they keep cutting me down last time in half and put me on oxymorphone got a call yesterday to stop taking and to just take the 15 mg oxycodone 4 times a day until they can see me agian in a month away I was barely getting by last month no way 4 15 are going to get me by trying to run a business and can't even walk they had me on 4 30mg and 2 20 mg oxymorphone that was getting me by barely I would have never started this stuff if I knew this is how it was going to turn out my pain is just getting worse I have chronic Lyme disease and three herniated disc in lower back and arthritis in every joint actually locking up at times when you fill the oxymorphone it says not to just stop cold turkey which that what they just did my med run out Sunday I am tired of this place treating us like where on probation never failed one drug test or pill count for them please send me the info

It appears that thread started some time ago, so it isn't clear that class action suit is being organized? If it is, it will be filed against whom? If it isn't, maybe need to start over? Or at least organize to be politically active.

I;m not sure you understand the issue and your trial atty certainly doesn't. The laws haven't changed, the guidelines for prescribing have changed. Physicians are welcome to prescribe outside the guidelines but are at more legal risk when a pt complains or the Feds want to see your paperwork because you are prescribing outside the norm. I can't imagine a lawsuit is workable here, regardless of what the atty said.

The research demonstrates that pts on over a 100mg morphine equivalent (MME) are 4 times more likely to overdose on their meds. Thus, every major governmental body in the USA has "recommended" no doses over 100mg MME. Given the overdose "epidemic" this guideline is not a law, but it has become the standard of care and places a strong legal burden on physicians who prescribe more than that, so very few do. Good luck with the lawsuit.
