My doctor has had me on 1 mg xanax 4 times per day for 15 yrs now and oxycodone 30 mg 4 times a day. I was supposed to see him last Thursday to get my refills but when I called to make the appointment I was told that he quit indefinitely so now I'm going cold turkey without anything...my pharmacist faxed my refill orders several times last week & they told me they couldn't find my medical chart....1st time in 15 yrs my chart got lost & my refills for xanax were never called in to my pharmacy... Can he legally quit on me without informing me here in Arkansas?

Yes you can be dumped as a patient anytime, sometimes while standing there at your last visit. However stopping certain medications 'Cold Turkey' can be hazardous to your health, and for example if you suffer a stroke or other known problems when stopping Xanax you could attempt to sue the provider for malpractice.

The problem with trying to Sue for malpractice when taking meds that can be addicting is that you accept that risk when you accept and get the rxs filled. If you suffered irreversible damage like brain or heart damage that prevents you from making a living, it.is possible but.highly improbable that you can find an attorney to take your case let alone win it.

So far you can't find a Dr to prescribe the same meds and it is.highly doubtful you will be able to. Drs rarely prescribe that combination of meds any longer due to abuse and deaths from overdoses. You do need to find a Dr or go to an er and see if they will prescribe you meds that will ease the withdrawals some. They won't give you the same two meds you've been taking. But there are meds that will help that aren't addicting.

Based on what you've said here, it sounds like your Dr has lost his license to prescribe these meds. So you won't be getting any more rxs from him.

Thank you very much & I do have an attorney who knows I'm on these meds but he doesn't know yet that my Dr quit so I will call my attorney in the morning first thing....what's weird is my lawyer had questions for my Dr & told me that he was going to call my Dr the same week he quit...I'm the most worried about being off my xanax BC of the health risks that follows my boys' father was killed in 2005 & I'm so worried something will happen to me and my boys will be without not just their father but their mother too, I can't stop crying and I.am just so so worried I really wish I could go fifteen years back in time and tell that Dr "no, I don't want to be on xanax" but I was young and definitely wasn't thinking about myself becoming addicted to it....never knew I was addicted, never wanted to be an addict but it snuck up on me that's when I knew I was addicted, bc I "had" to have it. Thank u for replying to me. I'm only 35 years old and I am so afraid of dying or having stroke or seizures & whatever else risky that can happen to me.

this stuff has a lot of side effects when you stop it, I did some research years ago, I had some info about people who went off it. I don't recall anything serious just some strange side effects and feelings they had. I think you'll be ok, but you probably need to take something to calm you down. The side effects can last some time.

First of all Stace you are not addicted to the medication but dependent on it. This happens with most medication after taking if for a long period of time. For example lets say your blood pressure runs 150/90 which is high. The doctor put you on blood pressure pills to lower. After taking the medication you blood pressure is a normal 120/80. 2 years later (or even as short as a few months) you stop the medication. Your blood pressure will not just go back to the original 150/90 but because your body is dependent on it your blood pressure will go much higher possibly suffering a stroke or heart attack. That is why it is so important to taper off medication. This can even happen with even over the counter meds. If worse come to worse go to the ER if you start having problems. You also might want to go to the doctor office not just call to make arrangements to get your medical records and get better information on what is going on. Also is he the only doctor in the practice. Who covered for him when he was out of town. Maybe that doctor will take you on.

Well I recall something very serious Bri, near death is about as serious as it comes? Unfortunately there is no cause of action for a lawyer to become involved until after you pass away or have a stroke, seizure or heart attack. Doctors are trained to tell you about how addictive a substance might be, most have NO clue about withdrawal symptoms which start up very soon after discontinuing the drug.

You have no malpractice case. Have you applied for disability? You mentioned your attorney wanting to talk to your Dr. You do need to get a copy of your medical records ASAP. Especially is you have a disability or personal injury case already in the works. You also need to find a new Dr ASAP. Just don't be surprised when they won't prescribe you the same meds. There is nothing anyone can do to make another Dr give you the same meds you've been on.

The reason I have a lawyer is BC I was recently involved in a automobile accident. I'm afraid to have seizures, strokes, heart attacks or death. I'm more worried now than ever my sons already lost their father in 2005 I'm all they've got left

Stace, concentrate on finding a Dr.right now that can give you meds to easy the withdrawals from the xanex and oxycodone. Don't wait until you have to go to the er, although it may not come to that. And be sure and contact your Dr and get a copy of All your medical records. They must give them to you, for a fee if they chose under federal law. In cases on mental health drs, they can chose to not.release them directly to you.but they can release them to a third party. You do have to sign a release form, even if you are getting the copies.

Stace, your original post is 3 years old so I am sure by now you have corrected the issue especially if you had an attorney for a MVA. Clearly you would not be having seizures now from then.

I am a professional nurse; the anti-anxiety medications can if gone off cold cause seizures. Perhaps you need to update the post as to what medications you are on, how your legal suit fared and who you are seeing for pain management now.

Stace an addict seeks the drug for the wrong reason you are tolerant.

You should seek a psychiatrist for the many issues you face and he/she can refer you for therapy it will help you.

Get to a dr or er and they will give u something to ease the withdrawls so u don't die. u may not feel well for a while but u will be ok.

My post is definitely not from 3 yrs ago....had no problems at all back then concerning my pcp Dr & my refills everything was fine until Sept. 8th, 2015...that's when my treatment was discontinued on 9-9-2015....thank yall for all y'all's help but I did receive a doctor. ALSO got my REFILLS From my Dr.

Stace my apology although not my fault. Apparently when 10.0 updated on my system your post showed up in two spots one stated 2012. Since I cannot delete the last it sounds like you've attained your goal.

Anyone in pain with anxiety is usually not well treated for pain. Yes a tolerance to Xanax will cause rebound anxieties and potentially seizures if you go off cold. It is a good idea to use one pharmacy at all times especially if you are receiving medications for dual providers.

That's Patient Abandonment and Gross Negligence in the Practice of the Profession. When you say he "quit indefinitely," does that mean he "quite" practicing medicine or quite writing for Xanax?

There's recourse. He's committed Patient Abandonment, refusal to give you access to your records (required by law when a doc dies or retires) and my sister (who was Sex Crimes B bureau Chief for the County of New York for 10 years and two as Exec Asst DA), said she'd throw in "Reckless Endangerment" (i.e., endangering your life because of abrupt withdrawals. Not every pseudo-contract a doctor throw into one of his spate for forms are NOT legal or binding. You can't agree to take that risk — and that came from a Federal Court judge whom I know well. "He also advantage of her not being fully competent BECAUSE of those medications." (His son is MY cardiologist.) I think good prosecutor could get an Indictment and then there's the State Board of Medical Licensure, which has a number of administrative charges they can file against him. You DON'T go to an ER when you need ongoing meds. She should go to an ER and explain the situation calmly. If this clown was a "Dr Feelgood," the docs on staff will know the whole story. She may need a few days inpatient to be detoxed. It NEVER hurts to call the DA and her states equivalent of The Office of Professional Conduct. A staff rep will listen and tell her the options available from the State Board of Medicine.

Joey correct in NYS and miss this direction action and attention to criminal actions which essentially the employer (workers comp) recently tried to kill me and I also mentioned this in my position statement with proof--both through a physician and also other methods.

In other areas or states this does not occur. I really hope you and I connect and perhaps you know of a specialist who handles rare cases. Not willing to die yet.

Federal law gives you the right to get a copy of your medical records at any time for a copying fee, unless you have mental health impairments. In cases of mental health impairment a Dr can refuse to give you a copy of your medical records, but you can give someone permission to get them for you. Google patient access to their medical records, choose the Ghana.gov links.

Each state has its own laws regarding how medical records are to be handled when a Dr dies, closes their practice or moves. The states decide how long medical records must be kept in these situations. Even though some states have incorporated federal law into state law when it comes to the cost of medical records, not all of them have. Federal law states a search or administrative fee is not to be charged, but some states still charge this fee.

Speaking strictly as a Board-certified Psychiatrist observing this exchange, I would refer you to a good shrink — the sooner the better. Occasionally, I'm asked to consult in-hospital on whether a patient needs some in-patient or intensive OPD therapy and/or meds. I do my best not the present it as punishment. I said once, "Even we psychiatrists see our own shrinks." ENTER STAGE RIGHT, my own shrink and buddy, Dr. G....and btw, this is Dr. ..., my shrink. I owe him a lot. (I do. He has BALLS when it comes to the regulators. As a DO he graduated with Board-Eligibility on Family Practice and "the mentor of us al," Doc F, taught us to "take no s*** from anybody — you DON'T HAVE TO. You're MY BEST in all 50+ years. Give 'em hell when you have to, but Joey, be careful someone might actually speak Sicilian Dialect. Very few people can translate what I say otto voce, but it's NEVER pleasant. Find a qualified translator and I'll worry!

I think BL is correct. You were an adult and assumed the risk of addiction when you "signed on for this trip." Your bottles had Controlled Substances labels, etc. Don't freak — I'm on your side and I've made out clear that part of our job is monitoring scripts, quantities, etc., not just clinical signs and symptoms.

Also, you or your attorney can check on the status if your former doc's license online or, in the attorney;s case, with a telephone call. Sometimes a agreement to retire and surrender ones license covers the multitude if sins; if that;s what happened, he;d only show a "Retired - License Surrendered for Purpose of Retirement" and no details. Disciplinary action is public information, but you have to know where to look.

I fully agree. Nurse like P450 are as rare as diamonds but one who started with main now psychiatric a Psych NP (with an MSN) and with the prescriptive privilege as well. I alas treated nurses as equal partners in health care. What I don't like are those "streamlined" programs where the NP decides SHE/HE is the doc. I"m always open to collaboration, but that implies a discussion among equals.

I've had Seconal and Nembutal pre-op. Seconal was IM and Nembutal p.o. I was hospitalized and my mentor stopped by and rained Hell on the nursing staff if they didn't "get off their asses and fill my medication order —NOW." AS with all god administrators, they were twosomes to Charlie, and these folks left me uncomfortable on 2 x .25mg of Halcyon (brand). I'm a CNS Reducer and these just don't work on me. I was mesmerized; I never saw this side of Charlie (or Chuck) but it seemed most staff knew not to release the "the 'bad' Dr. S.". Seco- and pentotbarbital are still around. I guess you have to know where to lok. And yes, I needed 200mg po of Nembutal and 200g IM for the Seconal. I did sleep, however, I called a snatch of conversation and Dr Charlie's saying, "He has his own MD. state license and DEA Registration — he could order 1,000 of those pills if he chose to, so obviously he's not a addictive risk. No, do what you're told or do I have to get the Chief of Medicine down here?

Untreated pain leads to panic attacks that is why the best in the U.S. and my deceased prescribed Xanax or Ativan in addition to your pain medications.

RSD destroys REMS for life. I have not had REMS in over 20 years people.

One more is that untreated pain (not enough opioids) will give you panic and no sleep.

Get your PM to prescribe what is needed if they can.

I may not be around if I do not get a replacement physician soon; I have told those close to me this is it for me. Peace people.

Powerful sedative-hypntics prescribed in addition to opiates/opiids that can't "cover' the pain can lead to Mania. Hysteria, et. I'm not being mean to you; advising you of what it took a lot of PTS and DOCS to learn over the years, what it took generations for these docs and its to learn.I'm not sure if neuroleptics also compromised the analgesia of morphine or Dilaudid-type opiates/opioids. For a long time, my PM buds could send their pots and send them me for the tx of intractable insomnia,the pool of available hypnotics and docs wit the balls to do what ALL of us did back in the day has greatly decreased!

I'm sorry i must have gotten a message that wasn't for me, forgive me. But I am starting to regret my choice. I haven't slept in three months which would be fine if my hip and back didn't hurt so bad after 10 min . Maybe I could get something done. I'm seriously getting very discouraged idk what to do. I have appt with him Friday so I'll ask him what he thinks. Wish I could just get like three nights worth of Seconal ornebutol. Something but I know they'll never allow that. Why r u being so rude I am dependent on these drugs due to my disease of Ankylosing Spondylitis plus have had three surgeries in the last 2 years. I went to my dr and ask to be tapered off my opiates that I have been prescribed for 20 yrs almost. So wtf?
