Who Can I Contact To Take Legal Actions Against A Methadone Clinic For Kicking Me Out Of Their Program And Refusing To Medically Detoxing Me

I have been taking 80 mg of methadone for the past 6 months. I had 3 dirty ua's and they decided to kick me out of the program. When I asked them if they were going to medically detox me, they refused to do so. I know that this is illegal. Who can I contact to take legal action if I don't have the funds to so myself?

Thats crazy to me.. at my clinic, dirty UAs only got you no take homes.. they didnt even lower your dose.. and the times they would start detox was only if you missed a day,and then they bring you back up.. or if they didnt get their money... then they just detox you down... i have NEVER heard of someone being kicked off for dirty tests,and especially without detoxing them first... i have heard of no detox and being kicked out if you break any serious rules.. selling drugs outside,etc... but anyway.. i would just seek free legal advice to point u in the right direction..

Sorry but if you had 1 maybe you would be ok but 3 that makes them sound like your selling your methadone and figure 1 mistake ok 2 maybe three strikes your out yet they should sit you down and talk to you and tell you they will at least help you off. that's mean

Yes, I heard of this only in state program.
In a private methadone clinic, that does not happen. But, in the state program methadone clinic, there are alot of things that happened there. I was at a state clinic and they where detoxing me without even asking me or telling me. That's when I found a pay clinic and moved, and they are so much better, and never had a problem there.

That is insane,I have known people that were kicked out of clinics in the same fashion but they kicked out for violating clinic rules and regs,for example ,selling dope or pills,sneaking your dose out etc.State programs do kick people out for dropping dirty,but they do a 7 to 21 day detox.If you were at a private clinic you could drop dirty every month as long as they got there money.That just does not make any sense to me .we're there other factor

You can call the state board of pharmacy in your town and talk to them, I have!! over Dr's and they will tell you, or you can call your towns free lawyer service's but I don't think there is much hope, I don't want to sound mean but your lucky they didn't throw you out on the 1st dirty UA, 3 is really bad, cuz you signed a contract that states, if you read it, you cannot trade your drugs, or if they find anything else they have not given you in your UA then they have that right, I know people in just a medical office who have turned in a dirty one and that was that, cuz that is what the contract states, good luck do you have ins.? the Obama care? then you should be able to find a Dr and tell them you have a bad back or something and get it from a Dr, mine gave me methadone, 16 pills a day but after 10 yrs he dropped me and I have a botched back surgery, with a rod in my back, and am having trouble finding a new one, but the old Dr gave me one more Rx for 30 days until I found a Dr. I found one but he wants to wean me off of everything I have been on. So I need to find someone else, and with the new DEA law it is really hard to get anything, its so sad for people who really need pain relief.

First you always wanna file a complaint/ a formal grievance internally to the clinics PRO (patients rights officer)- administration personally! Never give yr grievance paperwork to someone else to turn it in. You simply ask for your PRO & ask for a grievance, fill out what happened & they will sign, u sign, & they have a witness sign. You get a packet of yr rights & this begins the official investigation which can take up to 2 weeks, however in most cases- it will stop yr detox or you being kicked out until the investigation is complete. If you are unsatisfied with the results of that investigation which surprisingly doesn't always come out bad or against the patients even if they have a dirty. So don't be afraid. This is what our program is for. If not satisfied, then you go to outside organizations, because they'll just send u back internally. There is always a process. Trust me. Im not sure what state your in but here in Ohio, you can contact the ADAMH BOard (614)-224-1057 & file a formal grievance there but what you wanna do is find out who funds the clinic your on & proceed with filing your complaint with them as well. The U. S. Department of Health & human services- Region V office for Civil rights (312)866-2359 / ODADAS (ohio department of alcohol & drug addiction services) (614)466-3445 /Disability Rights Ohio (614)466-7264 / or a (NATIONAL RESOURCE) US Department of Health & Human Services(HHS) (312)886-2359 or 1-877-696-6775. Also, you can get all the proper relevant information for filing these grievances straight from your clinic who has to give this paperwork in your intake packets upon admission as well as your clients rights booklets which are to be always available. Ask for one! It provides all that info that pertains specifically to the clinic in question. Godd luck- God bless!

I was kicked off methadone for 2 dirty ua's... one was in the beginning of the first month I started and was never informed about it but I knew it was, but my last one 8 months later was for marijuana and methamphetamine. Marijuana yes I confess to, but methamphetamine hell no. I asked to be retested several times and was refused. They said inpatient detox and will give you your dose in there at 12pm or turn yourself in by 6 pm and you'll get dosed in the morning. I work two jobs and couldn't ask to be given 3-7 days off on such short notice so I went threw cold turkey detox at home from 85mg to 0. I almost killed myself and my girlfriend from pain and black out's psychotic rages and fits and don't even remember.

u faild ur drug test 3 times..they dont have tio detox you they figure u are still useing so why detox u off one drug while ur still takeing other drugs u wont withdraw since u are still useing..basically its a waist of time to even try to take legal acation they gave u 3 chances and u still made ur choice to use while going to the clinic...thats all your fault noone elses

Yes it is illegal. Contact an attorney. Try one that does medical malpractice. They shouldn't charge you until you win your case. That's crazy. I had so many dirty uas and they never did that! In fact They're detoxing me 2 mgs a day for refusing to tell my psych Dr ,who gives me xanax, that I'm on methadone. They don't care if you're sick. They want to cover their butts and want that money! Bet if you were on medicaid they wouldn't have done that!

i was teminated because i forgot to turn in a perscription i was offered no grevience no nothing 15 years on methadone 67 years clean with take homes do i have a leaglly case in fall river,mass.very sick

Try a personal injury attorney. They ask for no fees upfront. Not sure you have a case though as you probably signed a contract.

I hope you feeling better by now. If you were a client for 15 years you must have signed a consent for treatment and confidentiality agreement when you started your treatment the specifics should have been included in that packet.as such that probably clears them of liability for termination of treatment for cause.Even without it very few attorneys will initiate a methadone clinic case because of the stigma this rx and its abuses has accumalated over the years.you may want to contact a local legal aid society in your area for specific recommendations. What's most important is your health and recovery tend to that first God speed....

I totally agree..dirty opiate tests indicate you may need more methadone! Not detox..ive been at my clinic since 2002..i get 2 weeks take homes at a time..dirty tests or refusals only get my steps reduced..less take homes..not kicked out...call another clinic and ask their policy..that's ridiculous unless they think what your taking is so dangerous mixed with methadone..are you taking benzos? That scares them becuz there's been so many deaths from taking methadone with benzos...good luck.

Wow. The abuses of power in these programs is out ofthe c control. Google Federal Guidelines for opioid treatment programs. Download it..read it... Then contact your local legal action center. I'm experiencing a similar situation. I contacted the compliance division and our governor as well as got in touch with the Justice Center. My next step is a civil suit. This is a personal injury. My life and recovery is at stake. This process calls four progress NOT PERFECTTION. We are addicts trying to get better a day at a time. Some of these people forgot where they came from. Fight for your rights... Put pen to paper and don't grow weary. You'll get results.

The was done to me as well ....the director tampered with my UAs, I have contest print outs with no requisition number on them....and every 4th screen would be dirty, and I called the GM and he told me to not say anything, well he told the director and she said I threaten the NP. Its a lie, I saw the NP the day before and she said see you in a month, I would like to know what legal actions I can do I want redwood toxicology to really have tamper proof cups. And I was refused to get quick dipped....wonder y?
