Will I Fail My Drug Test

I had been sick for some time with a really bad sinus infection and massive headaches. My wife is a medical doctor so she gave me some pills the night before I went back to work. I didn't know what they were and assumed it was some antibiotics and a few aleave so I just took them. The next day I get a surprise drug test at work. I tell my wife about it and she tells me she gave me an oxycodone she had left over from one of her prescriptions. I freak out and notifiy my job about what happened. They reply since I didn't have a prescription for the oxycodone i'm in trouble.... Now my work has me on standby to decide what is going to happen since now I failed a drug test. I did some research and can't find anything anywhere saying a real medical doctor can't give medications to patient on the spot, even if the patient is her sick husband. Can someone give me some guidance??

A physician can give medications to someone on the spot, so to speak, but it is supposed to be in a clinical setting or life threatening emergency and all medications given require written orders, in the case of life threatening emergency, such details may be written up after the fact.

Even as a physician, it is illegal for her to share her own prescription medications with anyone, regardless of whether or not they are a controlled substance.

So yes, your job has grounds to accept the test failure and, if they choose to report this to the government, your wife could face serious sanctions, fines and possibly the loss of her license. The government is especially strict and picky about the dispensing of controlled substances!

Pat0001, it actually depends on the type of test they do. Some tests just test for the presence of opiates, not the specific ones, in that case, you'd be fine.

However, there are other tests they can use that test for the specific opiate and a base amount of it, that they should see in someone who was taking their medications regularly, as prescribed. In that case, you would more than likely fail the test.

Most pain management clinics use the second type of test, which is more precise, so they can make sure you are taking the prescribe medication(s) and have not been using others, or selling your prescription.
