My Boyfriend Is Prescibed Roxicodone 30mg Can Boyfriends Doctor Make Me Take A Drug Test

Updated

I go to a completely different doctor who is in a different medical practice than my boyfriends doctor. my boyfriend was in a severe work related accident that changed his physical body for life, technically he would be considered disabled, handicapped , how ever you'd want to word it, I would just to prefer not to say what his specific injury is. what I will say about the accident, if 20,000 tons of steel is thrown into you with a crane, it will cause some severe permanent changes to your life. needless to say my bf has crippling chronic pain without his medications. for 5 years he has been prescribed 240 roxi 30s per month we had to move to a new state so he had to find a new doctor rgt off the bat the new doctor refused to give him the amount he has been on for years and took him down to 180 per month 2 months ago. & being cut down so many when ur use to taking a certain my bf was going to run out so he took some ms cotins he had left over from a 4 month old script from a pain clinic the doctor before this new one made him go to. this new doctor had not drug tested him before and the ms cotins were from a prescription that was his so he didn't think there'd be a problem w him taking them. well of course that appointment right after taking a few of the ms cotins the doctor did drug test him and he was positive for morphine the active ingredient in ms forum & there isn't morphine in roxicodone as we all know. the doctor flipped and didn't care that they were an as needed medication that was prescribed to him just a few months before starting to go to him. the doctor said "that was before you started seeing me so you should of flushed whatever you had left of that prescription." so his doctor cut his prescription in half!!!!!! ( is that even legal when somebody's been on a regimen for over 5 years to just cut em in half? I know its not ethical but is it legal?) So of course being cut completely in half not only is my bf in an incredible amount of pain he's also suffering withdrawl symptoms how is this legal &/or ethical!?!
And the doctor said "at your next appointment we'll discuss if I'm going to continue to treat you." Apparently the doctor had also researched me because we live together with the same address and I'm prescribed hydrocodone so I guess when the doctor typed in our address I came up. so the doctor is telling him he can make me start coming in for drug tests too bc we're in the same household and both prescribed narcotic pain medication and in his opinion that usually means the couple is in a co-dependant relationship abusing drugs together which is bulls*** for him to just serotype us especially when he has my bf medical records from the past 15 years and has never met me. I do not go to this doctor, I don't even go to a doctor in his practice. so I don't understand #1 how can he legally violate my hippa rights by looking up my records (he told my bf the name of my doctor, the office I go to, what I'm prescribed & the quantity) & #2 how can this doctor legally threaten to stop seeing my bf unless I start going in for random drug tests? Normally I would tell my bf to just find another doctor but this doctor is the only doctor in this state we moved to that accepts the insurance that covers his work injury unless we want to drive 2 & 1/2-4 hours away and with the price of gas & wear & tear it would be on our car who can afford to do a drive like that every 30 days? I've tried multiple search engines and can't find nething on the laws or his rights or mine when it comes to a situation like ours and really need some help and advice on what we should do so please help!!!

No, he can't make you go in for a drug test, but he can make that a requirement of continuing to treat your boyfriend, so it would basically be a catch22.

And yes, he can legally cut the amount he prescribes him , or refuse to prescribe them at any time, since they aren't considered life sustaining medications and being in pain isn't considered life threatening.

Yes, I know it it ridiculous and unfair, but that's how it works and, since it's his medical practice, there are certain rules he can make and you have to agree with them to be treated by him.

I wish I had more helpful advice, but if there's no other doctor that he can see, then I'm afraid his options are quite limited.

I am not sure, however, if you have an recourse with the privacy laws, but even if you do, that's not going to make him change how or if he continues to treat your boyfriend.

What state are you in?

They can cut the Rx in half :( My friend is on OxyIR 10mg, normally she gets 6 a day. Well she went to the ER for an infection in her face and they gave her Percocet 5/325 (she should've called her PM doc first but she didn't). Next time she saw her PM doc he flipped out and threatened to kick her out. She agreed to pill counts and he cut her script in half for the month as punishment (seriously screwed up when a Doc forces you to suffer as punishment). Anyways, last month her doc gave her the regular amount.

Sidenote: PM docs can be serious jackholes. I had a failed back surgery in July and was on Hydro/APAP 10/325 4-6 a day, my doctor wrote a script for 4 1/2 a day and told me I could take 6 a day. So obviously I ran out a couple days early and so I took some Percocet 5's that I had leftover from after the surgery. I told him that I did that at my next appointment and he flipped out on me telling me that it was illegal and could kill me (yeahhhh right) and threatened to kick me out of his practice. Well f that noise.. I went back to my family doctor, told him what was going on, and he told me to quit the PM doctor and he would help me find another one, in the mean time he has taken the time to listen to me and help me find a medication regimen that works. Thank God for good doctors, and screw alllll the bad ones. If you are in Washington State avoid Dr. Fitzhum with Washington Center for Pain Management. Every day my life was getting worse, and he wasn't helping at all. Not worth the $1500 bill I got for 2 appointments.

That was when we lived in Mn outside of Willmar. We moved there from Ohio. That was the amount his Dr in Ohio had been giving him for several years. Those plus Norco 10's for breakthrough. In Mn they refused to give him anything for breakthrough BC they said "unless you're selling no one should need more than that amount of Roxycodone a month." They gave him his scripts based on his medical records. He was in a horrible accident at work 7-8 years ago and has been a below the knee amputee on his right leg for 5years. That's why I think he gets such large amounts of pain meds. We're back in Ohio now. He goes back to his Ohio Dr tomorrow since living in Ohio for 2years. Since he hasn't seen him in that long I really don't know how it will go or what he will even get.

Hi to the lady who is worried about her man. He is blessed to have a lady so concerned. What is legal may or may not be ethical. Your .bf Dr. Has no right violating your legal rights under Hippa. By doing so he committed a crime. Which is an. Act committed. Or omitted. Violating a law which has a punishment attached to it. To.(GET BANK) LOL you should file a civil matter but. In my opinion you will win hands down and. Have no problem showing he fell below the standard of care in the community.. your .bf. testifying on your behalf you will get an easy 10 to 50 grand depending on your damages/ losses/ stress. Etc. I can tell you most casses never go to court and are plea bargained. Where his med-mal ins. 98% of the time will offer you most10 -15 grand to settle just b4 trial because they know win or loose they got to pay to go to trial and trust me the .bf Dr. Don't want the ink . He can be charged in criminal and civil matters. I would love it if you could tell me the Ohio Dr that was cool enough to write your .bf 240 roxicodone. It would be a major blessing I live Ohio line. Broke .mt neck Oct 26 4yrs ago and I suffer big time. I can help you by filing all paper work in your civil matter and do it for free and/or guide. You to the right atty that will SHOW YOU THE. Money. Lol
